1. General Terms
1.1. The Valguskate OÜ online store sells custom-made pleated blinds, roller blinds, and cassette roller blinds based on the measurements and information provided by the customer.
1.2. These Terms of Use apply to the legal relationship between the customer (hereinafter referred to as the “Customer”) and Valguskate OÜ (hereinafter referred to as the “Seller”), the owner of the online store located at www.valguskate.ee (hereinafter referred to as the “Online Store”), in connection with ordering and purchasing products from the Online Store. In addition to these terms, legal relationships arising from purchases in the Online Store are governed by the laws and regulations of the Republic of Estonia.
1.3. The Seller may change the terms of use of the online store and the prices of products and services without prior notice.

2. Prices
2.1. All prices displayed in the Online Store are in euros and include value-added tax (VAT).
2.2. If the prices presented in the Online Store are disproportionately high or low due to a technical error, and the mistake can be reasonably justified, the Seller has the right to cancel the order and refund the amount paid to the Customer.
3. Products
3.1. The availability of all products is guaranteed within a reasonable quantity.
3.2. If the Customer places an order but it becomes apparent that the order cannot be fulfilled within the timeframe stated in the Online Store, the Seller will contact the Customer and offer the quickest possible solution. If the Customer does not agree with the proposed solution, the full purchase amount will be refunded within five working days.
3.3. The photos of the Products displayed in the Online Store may differ slightly from the actual appearance of the Product. Minor differences in color tone, details, or mechanisms are the Customer’s responsibility when placing an order via the Online Store. The 14-day right of withdrawal does not apply to custom-made pleated blinds, roller blinds, or cassette blinds, in accordance with the Law of Obligations Act (LOA § 53 (4) clauses 2 and 3 in conjunction with § 56 (1)).
4. Making a Purchase
4.1. The Customer selects the desired Product in the Online Store according to the instructions and adds it to the shopping cart by clicking the “Add to cart” button, after which the Customer is redirected to the Cart page.
4.2. On the Cart page, the Customer can see which products have been added and at what price. If desired, products can be removed. The Customer can also choose whether to pick up the product themselves or use a courier service.
4.3. To place the order, the Customer must click the “Checkout” button, after which they will be redirected to the order placement page.
4.4. After entering the required information and verifying its accuracy, the Customer selects a suitable bank link and confirms the order by clicking the “Place Order” button.
4.5. The Customer pays for the Product immediately via the bank link and confirms the payment to the Seller by clicking the “Return to merchant” button.
4.6. After payment, the Online Store will send an order confirmation to the Customer’s email address.
4.7. The Customer is obliged to provide all necessary and accurate information required for fulfilling the order.
4.8. The Seller is not responsible for any inability to fulfill the order or for any consequences arising from incorrect information provided by the Customer.
5. Payment Methods
5.1. Orders can be securely paid for using Estonian bank links (Swedbank, SEB, Nordea, LHV, Luminor, Danske, Coop Pank, Citadele, Revolut).
5.2. Payments are processed outside the Online Store environment in the secure payment environments of the service provider Montonio Finance UAB.
5.3. The Seller does not have access to the Customer’s bank or credit card details.
6. Delivery
6.1. The Customer can pick up products themselves at Kuma tee 10, Peetri, Tallinn — free of charge.
Opening hours: Mon–Thu 10:00–17:30, Fri 10:00–15:30.
Alternatively, the Customer can order delivery via courier service to a suitable address through OSC courier service.
6.2. Within Estonia, courier delivery (7–10 working days) costs the Customer 5 euros and is free for orders of 4 or more products (textile roller blinds, cassette roller blinds, pleated blinds).
6.3. If the Customer wishes to return a product, the product must be returned in its packaging at the Customer’s expense to the address: Kuma tee 10, Peetri alevik, Rae vald, 75312 Harjumaa.
6.4. The Customer is obliged to verify the accuracy of the contact details provided before placing an order to avoid delays and misunderstandings in product delivery. The Seller is not responsible for delays or misunderstandings in delivery caused by incorrect or inaccurate information provided by the Customer during order placement.
6.5. If the Product does not arrive to the Customer in good condition and in a sealed package, the Customer must notify the Online Store by sending an email to info@valguskate.ee with relevant photos attached.
7. Order Returns and Exchanges
7.1. According to the Law of Obligations Act, the 14-day right of withdrawal does not apply to custom-made products produced based on the Customer’s input (LOA § 53 (4) clauses 2 and 3 in conjunction with § 56 (1)). The Seller may exchange or accept the return of a product if the reason is related to the product’s quality or functionality. The Seller will not accept returns if the reason for return is incorrect input data entered in the online environment, improper usage conditions, or minor color differences between the Online Store images and the product delivered to the Customer.
7.2. To return or exchange products, the Customer must submit a withdrawal request to the Seller within 14 days of receiving the goods. The withdrawal request can be submitted by sending a clear, unambiguous email to info@valguskate.ee. Returns are accepted only together with the withdrawal request.
7.3. The product to be exchanged or returned must not be damaged or show signs of use and must be in its packaging. The Customer is liable for any decrease in the product’s value resulting from handling it in a manner beyond what is necessary to establish the nature, characteristics, and functioning of the product. To establish these, the Customer should handle and use the product only as would be permitted in a physical store.
7.4. In case of order return, the Seller will refund the Customer the entire amount received under the contract, including the delivery cost paid by the Customer. If the order is returned partially and delivery costs were incurred, the Seller may refund the delivery costs proportionally to the number of returned products.
7.5. The refund will be credited to the Customer’s bank account no later than the next banking day. For credit card payments, the refund is subject to the Customer’s bank’s terms.
7.6. The Seller will refund the purchase amount to the Customer within 14 days from the receipt of the withdrawal request. The refund will be made to the same payment account from which the Customer paid for the returned order.
8. Procedure for Submitting Complaints
8.1. The sold Products are subject to a 2-year complaint submission period as stipulated in § 218 (2) of the Law of Obligations Act (LOA).
8.2. If the Product does not conform to requirements or defects appear, the Customer is obligated to notify the Seller immediately, but no later than 2 months after discovering the defect, by sending buyer’s contact details, a detailed description of the problem, and the invoice number to the email address info@valguskate.ee. Upon discovering a defect, please immediately stop using the Product.
8.3. All complaints will be reviewed and the Customer will be contacted as soon as possible, but no later than 14 days from receipt of the complaint.
8.4. During the first six months after the Product has been handed over to the Customer, it is presumed that the defect existed at the time of handover. The burden of disproving this presumption lies with the Seller. In the event of a complaint during the first six months from handover, the Seller always bears the costs related to repair or replacement of the Product, including transport, postage, labor, travel, and material costs (LOA § 222 (4)). For the following 1.5 years, the Seller bears such costs only if the complaint is justified.
8.5. The consumer has the right to demand a price reduction or contract termination and a refund from the Seller if the Seller cannot repair or replace the Product, repair or replacement fails, the Seller does not remedy the defect within a reasonable time, or the consumer has been caused undue inconvenience.
8.6. In case of non-conformity of the Product with the contract terms, the consumer may rely on statutory remedies, including demanding contract performance, price reduction, compensation for damages, or contract termination.
8.7. In case of non-conformity, the Seller bears the costs related to repair or replacement of the Product, including transport, postage, labor, travel, and material costs.
8.8. The Seller is not liable for damages caused by improper use of the ordered Products or for delivery delays caused by circumstances beyond the Seller’s control and/or due to force majeure.
8.9. The Seller does not compensate the Customer for expenses related to non-conformity or defects if: the Product’s value has decreased or it has been damaged due to the Customer’s fault; defects are due to improper use, including failure to follow maintenance instructions; the Product’s value has decreased due to normal wear and tear; proof of purchase is missing. The Seller does not cover costs related to incorrect installation or use. The Seller is responsible for installation only if performed by the Seller or the Seller’s representative.
9. Liability
9.1. The Seller and the Client are liable to each other for damages caused to the other party by violating these Terms of Use, in cases and to the extent stipulated by the laws of the Republic of Estonia.
9.2. The Seller’s liability is limited to the purchase price of the Product.
9.3. The Client undertakes to use the online store service solely for purposes that comply with the law and good practices.
10. Privacy Policy
10.1. The Client gives the Seller clear and informed consent for the processing of their personal data.
10.2. Personal data provided to the Seller is entered into the customer register and used to provide sales services and offer goods to the Client.
10.3. The Seller retains the contact details entered by the Client and information about purchases made during the purchase process. This information is treated as confidential and processed in accordance with the Personal Data Protection Act.
10.4. Personal data necessary for sending the Products to the Client is transmitted to the courier service provider.
10.5. Personal data required for payment processing is transmitted to Maksekeskus AS and the bank selected by the Client.
10.6. The Client’s personal data is not disclosed to parties unrelated to the transaction or to third parties.
10.7. The Seller may use the Client’s personal data to send information about special offers and campaigns to the Client via email. The newsletter includes instructions for unsubscribing.
10.8. The Client has the right to request the deletion of their data from Valguskate OÜ’s database.
10.9. Data communication between the Client and banks as well as the card payment center is encrypted, ensuring the security of the Client’s personal and bank data. Payments are processed outside the online store environment, in the secure payment environment of the relevant bank or service provider. The online store does not have access to the Client’s bank or credit card data.

11. Terms of Use and Their Modification
11.1. By making a purchase in the E-shop, the Client agrees to the Terms of Use of the E-shop and undertakes to comply with them. The Terms of Use are available in the footer of every subpage of the E-shop.
11.2. The sales contract between the Seller and the Client comes into effect upon the receipt of the payable purchase amount in the Seller’s bank account.
11.3. The Seller may change the Terms of Use of the E-shop and the prices of products. Notice of changes will be published in the E-shop environment. The transaction will be governed by the Terms of Use and prices valid at the time of the transaction.
11.4. The Seller has the right to refuse to fulfill an order if, due to a technical error, the displayed price of the Product in the E-shop was incorrect.
12. Other Conditions
12.1. Any disputes arising between the Client and the Seller shall be resolved through negotiations.
12.2. If the Buyer has any complaints regarding the Online Store, they must be sent by email to info@valguskate.ee or by phone at (+372) 5743 1888.
If the Buyer and the Online Store are unable to resolve the dispute by agreement, the Buyer may turn to the Consumer Dispute Resolution Committee. The terms of the procedure can be reviewed, and an application submitted here. The Consumer Dispute Resolution Committee is competent to resolve disputes arising from the contract concluded between the Buyer and the Online Store. Reviewing the Buyer’s complaint by the committee is free of charge.
